Terms of Service

1. Acceptance

By creating an account or making a purchase on kreato.co.in, you agree to these Terms of Service. If you do not agree, do not use the platform.

2. The platform

Kreato is a marketplace that connects digital asset creators with buyers, operated by Clyrosoft Solutions OPC Pvt. Ltd. Kreato is not the seller of the assets - creators are the sellers. Kreato facilitates discovery, payment, and delivery.

3. Asset disclaimer - third-party content

All digital assets listed on Kreato are created, owned, and sold exclusively by independent creators. Kreato does not create, review, verify, endorse, or take legal responsibility for any asset listed on the platform.

  • Kreato acts as a payment facilitator on behalf of the creator - we collect payment from buyers and remit earnings to creators, but we are not the seller of record for any asset
  • Kreato does not warrant the quality, accuracy, originality, or fitness for purpose of any asset
  • Any intellectual property claim, copyright dispute, or legal liability arising from an asset rests solely with the creator who uploaded it
  • Buyers purchase assets at their own discretion. Kreato is not liable for any loss or damage resulting from the use of a purchased asset
  • If you believe an asset infringes your intellectual property, contact us at hello@kreato.co.in and we will investigate and remove it if warranted

4. Creator accounts

  • You must be at least 18 years old to create a creator account
  • You must provide accurate bank and tax details for payouts
  • You are responsible for the accuracy of your asset descriptions and pricing
  • You retain full ownership of the digital assets you upload
  • By listing an asset, you grant Kreato a non-exclusive licence to display and deliver it to buyers
  • You must not list content that is plagiarised, illegal, or violates third-party intellectual property - see Section 8 for full prohibited content rules

5. Platform fees

Kreato charges a platform fee on each sale:

  • 5% flat fee on every sale
  • Payment processing fees (~2%) are absorbed by Kreato and not charged to creators
  • TDS at 1% under Section 194O may be deducted once your annual gross sales exceed ₹5,00,000

6. Payouts

Creator earnings are paid out weekly to the registered bank account. Kreato reserves the right to delay payouts in cases of suspected fraud or disputes. Payouts require a valid bank account and PAN on file.

7. Buyer purchases

  • All purchases are for personal or commercial use as specified by the creator's listed license
  • Download links are valid for 3 downloads and expire thereafter
  • Buyers receive a GST-compliant invoice via email for every purchase
  • Kreato is not responsible for the quality, accuracy, or fitness of assets sold by creators

8. Prohibited content

The following content is strictly prohibited on Kreato, regardless of whether it is hosted on our servers or delivered off-platform:

  • Sexually explicit material, nudity, or pornographic content of any kind
  • Sexual services, escort services, sexting, or any adult service sold via the platform - including where payment is collected on Kreato and the service is delivered elsewhere (e.g. Instagram, Snapchat, Telegram)
  • Content that depicts, describes, or sexualises minors in any way - this is a criminal offence under POCSO and the IT Act and will be reported to law enforcement
  • Content that violates Indian law including IPC Section 292, IT Act Sections 67, 67A, and 67B

Kreato may immediately suspend accounts and permanently delete all associated content and files without notice for violations of this section. Pending earnings may be withheld pending review.

9. Prohibited conduct

  • Uploading content you do not own or have rights to sell
  • Attempting to circumvent the platform fee
  • Sharing download links or reselling purchased assets without the creator's extended licence
  • Fraudulent transactions or chargebacks
  • Impersonating other creators or misrepresenting your identity

10. Termination

Kreato may suspend or terminate accounts that violate these terms, at our discretion. Pending earnings at time of termination may be withheld if the account was terminated for violations of Section 8 (prohibited content), fraud, or chargebacks. In other cases, pending earnings will be reviewed and paid out within 30 days.

11. Limitation of liability

Kreato is not liable for any indirect, incidental, or consequential damages arising from use of the platform. Our total liability is limited to the platform fees earned from your account in the 3 months prior to the claim.

12. Governing law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.
